DUI Charges Against Lowe Dropped

Hello again everyone from the Northern Front in the Great Weather War Of 2011!

On the Baseball Front, players performing badly off the field division, word came down today that DUI and reckless driving charges were dropped against Derek Lowe.

Lowe had been charged with both offenses around 10 PM on April 28th in Buckhead. In what, to me at least, was a stunning development, prosecutors cited lack of evidence in dropping the charges after reviewing video from the dash cam of the police cruiser, and in spite of the fact that Lowe refused to take a breathalyzer test. Lowe did plead guilty to an illegal lane change.

I’ll preface this comment by saying that I am not an attorney nor have I kept up with the traffic codes in GA, but I do know that it is established case law, by the Supreme Court if I am not mistaken, that an operator of a motor vehicle does not have the right to refuse the breathalyzer test. To refuse generally carries the same weight as a guilty plea. I don’t know about alcohol, but this situation doesn’t pass the smell test, at least to me. I wonder what that video shows?

I bet Lowe is a big supporter of video replay now! And, on a serious note, I bet MADD launches a huge offensive over this. Do you think MLB or the Braves will respond? Should they?
